Penalties for Drivers Aged 21 and Over
As in all US states, 21 is the legal drinking age in Rhode Island. If you are legally old enough to drink and are convicted of driving with a BAC of .08 or above, you could face penalties such as:
- A fine of $100 – $300 (higher if your BAC was over .10)
- Between 1 and 3 years in jail, depending on your BAC
- Up to 60 hours of community service
- Driver’s license suspension or revocation
- Mandatory alcohol abuse treatment
- Mandatory installation of an ignition interlock device in your vehicle

As with older drivers, the penalties increase for each subsequent offense. In addition, drivers who are under age 18 tend to face stricter penalties than drivers who are between the ages of 18 and 21.
