Can I be arrested for DUI even if I’m not actually driving?

In a way, yes. The law does not distinguish between someone who is actually driving down the street and someone who is in a position where they have full control and capability to operate the vehicle. In other words, even if the car is not actually moving, you can be arrested for DUI if you are sitting behind the wheel with the key in the ignition.
