Police Report: Defendant was pulled over for almost hitting a stopped car. The officer described the defendant as having a strong odor of alcohol, watery eyes and a red flushed face. The defendant admitted to consuming alcohol after the officer told the defendant he had seen him in a bar a few hours earlier. The officer concluded the defendant failed all three field sobriety tests given. The defendant was arrested and asked to submit to a breath test at the police station. The defendant refused to take the test and had a prior refusal from 2006. At trial, two police officers testified the defendant was intoxicated and refused to take a breath test.

The arresting officer immediately detected a strong odor of an alcoholic beverage emanating from his breath. The officer describes the defendant’s eyes as being bloodshot and watery and he was swaying as he tried to lean against his car. The defendant’s speech was slurred and he continued to sway as he spoke. The defendant submitted to a series of SFST’S (Standardized Field Sobriety Tests). The defendant was given the HGN (Horizontal Gaze Nystagmus) test in which the officer observed the lack of smooth pursuit in both eyes, distinct nystagmus at maximum deviation and the onset of nystagmus prior to 45 degrees in both eyes. The defendant was given the walk and turn test which he failed by swaying, stepping off the line, making an extra step and almost fell at one point. The defendant was then given the one leg stand test in which he failed by putting his foot down several times, not keeping his hands to his side and stopping count at 3. The defendant passed the finger to nose test.

The officer detected a very strong odor of an alcoholic beverage emanating from the interior of the car. The defendant had severely bloodshot eyes watery eyes and dilated pupils. The defendant responded to the officer’s request for her license by staring blankly at him and appearing very confused. Her speech was extremely mumbled and barely understandable. The defendant had a blank stare, almost fell getting out of the car, could not produce documents asked of him, had a strong odor of alcohol, failed the HGN Nystagmus test, walk and turn test and one leg stand test.

Police Report: The police observe the defendant spinning his wheels and accelerating at a high rate of speed. Upon a traffic stop, the officer detected an odor of alcohol, slurred speech and bloodshot and watery eyes. The defendant was wearing no shoes and no shirt. The defendant was given the Horizontal Gaze Nystagmus Test (HGN) and the officer observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation and onset of nystagmus prior to 45 degrees, all in both eyes. The defendant was given the walk and turn test in which he swayed and lifted his arms, stepped off the line and did not touch heel to toe. The defendant was given the one leg stand test which he swayed and used his arms for balance. The defendant submitted to a breath test and registered a deficient sample of .112% and a sufficient sample of .120%.
